At no point was writing off the car mentioned. Then i got a call from the garage dealing with my car (NF appointed) a week later telling me of the damage and repair value and that the engineers working for the NF, different company again, were going to deem the car a write off, CAT D as i later found out. Now the fun part - the engineers have made an offer for settlement and to write off of my car, which is a good 500 below what is would cost to replace it with a like-for-like car in my local area (replace cost circa 2.8k-3k) they are adamant they will not repair my car even though the repairs would cost LESS than the write off - because the repair is too close to the market value and they can make a killing on salvage apparently. so fighting this out at the moment. NOW FOR THE QUESTION: They have advised me that should i wish to keep the car after they write it off (which i want to avoid if at all possible) i can accept the settlement and pay them a salvage fee to retain my car. This i understand as technically they buy my car when they write it off and then i have to buy it back. The problem is that they have a flat 30% !!! salvage fee which on their offer would almost negate me being able to get the repairs covered. What i really need to know is if anyone else has been in this position and if there is a maximum salvage fee they can charge - bearing in mind that this is my car to start with - and if there is any way i can make them drop this percentage. Forcing them to drop the percentage might not only let me repair the car after retaining but might also swing in favour of repair instead of write off if they cannot justify such a big payout for themselves. Any help here would be appreciated fast as i'm still bouncing between the parties here to get this resolved. In case your wondering the damage constitutes a bumper rear panel and a kink in the boot floor - VERY repairable.

I don't get it, why does insurance cost more (4000 - progressive) for 2005 Nissan Frontier then for a 2003 BMW z4 (2500 - Progressive).... and its not only that, it costs less for a corvette then for a v6 mustang... I have been trying to cancel my policy for 3 months. I even tried to stop payment at my bank, but they keep getting around the stop payments by charging different amounts each month. (This month they decided to charge me $50 more than last month) When I call them, I am on hold for over 30 minutes before I finally just give up. Question about auto insurance claim pay?

Someone I know got into an auto accident (backed into a parked car). Both parties are insured. The guy I know filed an insurance claim and they find him 100% at fault (duh), but the insurer will not give him any money as a result of this. I've never had to file any auto claims in all my time driving (thankfully), so I don't know as to whether what happened is what's supposed to happen. If you're 100% at fault, is it standard for insurers to give no payout at all? I don't know the terms of this guy's insurance policy (told me he uses farmer's insurance, if that matters, not Geico or some other budget insurer), but I thought the purpose of insurance is to cover yourself in the event of accidents, whether you're at fault or not. Should I tell him to appeal, or something, or is the insurance company 100% justified in their decision?

About a year ago at this time, I was involved in a car accident where I was turning left onto a 2lane road (stop signs, MY turn) and this girl was turning right onto the same road. She tried to beat me and get in my lane. She ran into my car. Long story short, her fault, no questions asked, even says so on the police report. I filed a report and claim with my insurance co. to get $$ to fix my car. I got the $$ and fixed my car. Well, I was trying to chance insurance co. the other day when I found out that apparently this lady called my ins. company claiming to be my 'mom' admitting fault to the accident. I was 19 at the time, and this was at MY college. So now, it's gone on my record as my fault. A while back, my husband drove my moms car and totaled it. At the time, we had no car, so we werent carrying insurance. A telephone pole had to be replaced. ANYWAYS, my parents insurance said they are going to cover it. Since then, my husband and I bought our own car and our own insruance. Last week, in a quirky weather situation, the street I live on got super-slick just long enough for my 2000 Toyota Camry to go into a 300' free-slide down the hill and crash into a curb and a tree. It was a one-car accident, no one was injured. The repairman can only give me a rough estimate at this time but he thinks it'd cost about $1500 to repair using old body parts, although he says it could cost more if he finds more damage as he goes along--in that case he thinks it might cost up to $2,000 to patch it up out of pocket. I asked him about the pros and cons of paying out of pocket vs. going through insurance in my particular case. He said that if I chose to go through insurance--which would mean getting a USAA adjuster out and all--that he was thinking it would probably cost $2500 to repair, maybe more if it turned out there was more damage that he could see at this time. But he pointed out that I'd have to pay the deductible (which I think is $500 for my car, not sure) and that my insurance rates would go up. But then you'd end up with a new-looking car. [as opposed to a patched-up looking car]. My husband absolutely wants to pay out of pocket--he does not want to involve our auto insurance company, saying, The insurance company is only for the big accidents. But I'd like to keep this car for several more years if I can because there's no car out there that I like better, so I'm wondering if maybe it might be worth going through the insurance company. Here's a little more information: My 2000 Toyota Camry has 115,000 miles on it and has been very reliable over the years. The motor wasn't damaged and, in fact the car is already driving well again except that one headlight and blinker are broken. I got one 3-4 years ago for speeding--35 or 40 mph in a 25 mph zone-. If my points from this ticket have expired by now (not sure), then there are no other points on our record. Our children are now out of the nest and only one of them borrows our car when she comes to visit once every month or two. I put less than 10,000 miles/year on my car for work and vacations. We live in PA. So my question is this: Given the age of the car, amount of damage, etc., is it worth going through our insurance company to get the car fixed rather than pay OOP--or would going through insurance raise our insurance premiums so much that it wouldn't be worth it?

My wife and I have credit scores of just over and just under 800. Wanted to lower our current mortgage from 5.5 13.5 years remaining, to 3.5 15 yr., at the same Bank, who we are happy with. During the closing process the Loan Officer said we would have to get FEMA (Flood Ins.) in order to get a new loan. Insurance will be around $2000 a year. We have lived in this house 7 years and never heard of needing flood Insurance. Supposedly, as of last year the flood plane has changed. Bank had our home surveyed and one corner of our home is in the plane. we were wanting to refi 100k (we owed 90k). House easily appraise around 150k. So can and will FEMA come and make me pay $250. a monthy for Insurance I don't want. And also why would we HAVE to Insure at 170,000 when we owe 100k. We have worked hard to earn our credit scores. This has stopped us from refinancing and getting squared away. So we can help our kids with college More. any help or advise is appreciated?

Auto Insurance Question on a Hit and Run?

My boyfriend is not listed on my insurance because he has a company vehicle that his boss lets him drive. Anyway today he decided to take my car to go pick up our daughter from school. As he was backing up he backed up a little too quick and hit one of the teachers car. He said he looked out the window and saw there wasn't any damage and took off right away. All it did to our car was literally chip the paint but I wasn't sure what he did to the other car. Anyway I was out shopping later this evening and got a phone call from my partner stating that the cops were at our house and wanted to see my insurance slips and ownership. So I went home and gave them all the information. They ended up letting my husband go on fleeing the scene of a accident but gave him a $110 fine for failing to report the incident. Now here's what I am wondering, I have to call my insurance company tomorrow and notify them that he was driving my car and let them know all the information but I'm unsure what will happen? I can almost guarantee that my insurance will go up but is there any regulations about hitting a parked car within a private parking lot? I know that if she decides to go through the insurance company (which I'm sure she is because she gave all her information to the cop) then I was told I am able to request that she gets 3 quotes from 3 different places so that she doesn't try to stiff me and go for the most expensive. The cop also told me that I have the option to call her and maybe see if she will take cash but I know this teacher and she is one of the worst teachers I have ever met so I highly doubt she will be so accepting of the money. The cop also told us that he went to go view the damage on her vehicle and he said the front number was cracked so it would need to be replaced. He said it's not extensive damage at all but damage nonetheless. What is my best bet in this situation? I am screwed either way? Because I know when I signed up for insurance one of the questions she asked was is there any other licensed drivers in the household and I told her no but my boyfriend is a licensed driver but just doesn't drive my car. He is also not on my lease so I can always say that he just moved in after Christmas which at the time I filled for insurance he wasn't living with me. In 2005, as part of our divorce agreement, my ex and I decided to keep the same auto insurance but under separate policies. We had been with this company for years. My policy was on auto pay meaning that the payments were taken directly from my account. He walked in to pay his. About 6 months after the divorce, I was pulled over for a routine traffic stop and was told I was driving an uninsured vehicle. Without insurance, my registration was also invalid. Both tickets totaled 1K. My car was taken into impound. I checked and found the officer was correct. On good terms with my ex, I told him what happened. He said for the past 6 months, each time he went in to make a payment, the girl HIS was already paid. Realizing what had happened. They were applying my payments to his automobile. I was furious. I notified the agent who initially did not want to accept blame, but since the payments were automatic and my account number was on each payment they took, they were responsible. The error was compounded by the fact that the cancellation notice went to HIS address (how dumb was that!) So I had no way of knowing that I was cancelled. I was without a car for 2 weeks and lost my job. After much haggling and many sleepless nights of wondering what to do without a job or a car, the insurance company finally admitted blame, paid the impound fees of $1,250.00. The agent also said they would handle the 2 tickets totaling 1K. FAST FORWARD TO 2010 in my state, the county did a scofflaw sweep and I was summoned to court with over 5 thousand other delinquent drivers to address unpaid tickets. The order was come to court by April 30th or be arrested. Realizing this had to be a mistake, but fearful of the law, I stood in line for over 5 hours in blazing heat, then sat in court another 5 hours waiting for my day in court. I was immediately threatened with arrest because the 2 tickets were not paid. Up to that moment, I had no idea the insurance company had not paid the 2 tickets. This time, not only was my insurance and registration cancelled, my license was suspended due to the age of the infraction (5 years). In front of the judge, I called the agents' office only to be told by the secretary that they had no intention to pay the ticket. Paying to get the car out of impound was enough. When the judge heard this she was shocked and let me off with a promise to pay in 5 days. She made me promise not to drive. With no way to get home but drive, I took a chance, and was pulled over. The officer informed me that due to the vast number of outstanding cases, tags bearing our county name would be targeted for a while (talk about a police state!). I showed him my documents from the court and headed home. This is a nightmare. Would I have a case if I filed suit against my insurance company for failing in their fiduciary responsibility to a 16 year client in good standing? By the way this company is one of the largest in the country.

I live in Tennessee and moving down to Florida in early August and in Tennessee at age 16 you can get a license called Intermediate Restricted Driver License which just has more restrictions then a 17 year old and less restrictions then a 15 year old/permit. I'm not sure if Florida has these type of licenses but at the age of 16 with a Tennessee Intermediate Restricted License, to get a Florida license, must you show proof of insurance before you get your Florida license? The reason why i'm asking this is because obviously in Tennessee you do not need proof of insurance to get a Driver License. Thanks Guys!

Today I went about an hour away to purchase a second car. On the drive back it began snowing and the roads got very bad. I was driving my old car and a friend was driving the new one. Husband & wife both have group medical insurance with their employers. His insurance is a bucket plan through Cigna called an HSA. It pays for the first $750 & then he has to meet another $750 before anything else is pd. Her insurance is Healthlink PPO with $250 deductible. If husband's insurance pays for his chiropractor bills in full (as not over $750 total) can these bills be submitted to her insurance to help meet the family deductible of $500? We live in IL.
